Welcome to DIY Your Biz. These Terms of Service (“Terms”) govern your use of the DIY Your Biz website, our website design and development services, and any other digital services we provide.
By accessing our website, requesting a quote, making a payment, or engaging DIY Your Biz for a project, you agree to these Terms.
1. About DIY Your Biz
DIY Your Biz provides digital solutions for businesses, including website design and development, landing pages, sales funnels, e-commerce websites, website maintenance, integrations, search engine optimization (SEO), analytics and advertising tracking setup, and related digital services.
The exact scope, price, timeline, and deliverables for each project will be communicated through the applicable quotation, invoice, proposal, project brief, or other written agreement.
2. Our Services
Our website packages may include features such as:
- Website design and development;
- Mobile-responsive design;
- E-commerce functionality;
- Local and international payment integrations;
- Order and receipt functionality;
- Logistics or delivery integrations;
- Search engine optimization;
- Analytics and tracking setup;
- Meta Pixel and Conversion API integration;
- Contact forms and WhatsApp integrations;
- Domain and hosting configuration;
- Website maintenance; and
- Other agreed functionality.
Not every feature is included in every package. Your specific deliverables will be those stated in your quotation, invoice, proposal, or written project agreement.
3. Pricing
Website services may be advertised as starting from a particular price. “Starting from” pricing represents the minimum price for qualifying projects and does not mean every website will cost that amount.
The final price depends on the project's requirements, complexity, number of pages, functionality, integrations, custom development, content requirements, and other agreed services.
We will communicate the applicable price before commencing paid work.
4. Payments
Payment terms will be stated on your invoice, quotation, or project agreement.
Unless otherwise agreed in writing, work will not begin until the required initial payment has been received.
Where payment is split into milestones, subsequent payments must be made according to the agreed schedule. DIY Your Biz may pause work or withhold delivery, transfer, publication, or continued services where an outstanding payment is due.
Third-party expenses such as domain registration, hosting, premium plugins, APIs, payment processors, email services, stock assets, or other external services may be charged separately unless expressly included in your package.
5. Client Responsibilities
To complete your website, we may require information and materials including your logo, brand assets, product images, business information, prices, written content, policies, payment details, domain information, and other relevant materials.
You are responsible for providing requested materials promptly and ensuring that information supplied to us is accurate.
Project timelines may be extended where required information, approvals, payments, or feedback are delayed.
6. Project Timelines
Any advertised delivery period represents the expected timeframe for projects that meet the applicable requirements.
A timeline begins once we have received the required payment, project information, content, and other materials necessary to start the project.
Timelines may change because of:
- Delayed client feedback or content;
- Changes to the original project scope;
- Additional feature requests;
- Third-party service delays or outages;
- Technical issues outside our reasonable control; or
- Other circumstances affecting project delivery.
Where reasonably possible, we will communicate material changes to the expected delivery date.
7. Revisions and Scope Changes
Your package or project agreement may include a specified number or period of revisions.
Revisions are intended to refine work within the agreed scope. Requests for new pages, functionality, integrations, substantial redesigns, or other work outside the original scope may require an additional fee and may extend the project timeline.
We will notify you where a request constitutes additional work before proceeding with chargeable additions.
8. Website Maintenance and Support
Where a package includes free maintenance for a specified period, the maintenance period begins from the website's launch or another date communicated in writing.
Maintenance generally covers reasonable technical support, bug fixes, and minor updates within the original website scope.
It does not automatically include major redesigns, new functionality, new pages, extensive content entry, third-party fees, or problems caused by modifications made by the client or another service provider.
After the complimentary maintenance period ends, continued maintenance may be available for an additional fee.
9. Domains, Hosting and Third-Party Services
Websites may rely on third-party services such as domain registrars, hosting providers, payment processors, logistics providers, analytics platforms, advertising platforms, APIs, email services, plugins, and other software.
Where appropriate, these services may be registered in the client's name or transferred to the client.
DIY Your Biz does not control third-party platforms and cannot guarantee their continued availability, pricing, performance, security, policies, or functionality.
Any third-party fees that arise after delivery remain the client's responsibility unless we expressly agree otherwise.
10. Payment Processing
Where payment functionality is included, we may integrate the website with third-party payment providers.
Payments are processed by the applicable payment provider and are subject to that provider's terms, fees, supported currencies, settlement rules, verification requirements, and policies.
DIY Your Biz does not hold or process customer funds merely because we developed or integrated the website.
11. Search Engine Optimization
Where SEO is included, we will implement the agreed technical and on-page optimization intended to improve the website's ability to be discovered by search engines.
However, search engine rankings depend on many factors outside our control.
We therefore do not guarantee a particular Google ranking, amount of organic traffic, number of enquiries, or sales result.
12. Advertising and Tracking Integrations
Where requested, we may configure tools such as Meta Pixel, Conversion API, Google Analytics, or similar technologies.
These integrations are intended to help clients collect relevant website activity and measure marketing performance.
We do not guarantee advertising performance, sales, return on advertising spend, or continued functionality of any third-party advertising or analytics platform.
Clients remain responsible for ensuring that their advertising, tracking, and customer-data practices comply with applicable laws and platform requirements.
13. Intellectual Property
Unless otherwise agreed, DIY Your Biz retains ownership of its pre-existing intellectual property, development methods, reusable components, frameworks, templates, systems, processes, and know-how.
Upon full payment, the client receives the rights to the completed website and custom deliverables specified for the project, subject to any applicable third-party licences and our pre-existing intellectual property.
Third-party fonts, software, plugins, photographs, templates, APIs, libraries, and similar materials remain subject to their respective licences.
14. Client Content
You retain ownership of content and materials you provide to us.
By providing such materials, you confirm that you own them or have permission to use them and authorize DIY Your Biz to use them as necessary to complete your project.
You are responsible for ensuring that your content does not infringe another person's intellectual-property, privacy, or other legal rights.
15. Portfolio Use
Unless otherwise agreed in writing, DIY Your Biz may display completed work, including screenshots and links to publicly launched websites, in our portfolio, social media, marketing materials, case studies, or other promotional materials.
We will not intentionally disclose confidential information when doing so.
16. Cancellations and Refunds
Because website development involves professional time, planning, design, development, and other resources allocated specifically to a client, payments for work already performed are generally non-refundable.
Where a project is cancelled before completion, any refund or outstanding amount will be determined based on the work already completed, expenses incurred, and the terms agreed for the particular project.
Any project-specific cancellation or refund terms stated in your quotation, invoice, or agreement will apply.
17. Prohibited Use
You may not use our website or services to engage in unlawful activity, infringe intellectual-property rights, distribute malicious software, interfere with website security, impersonate another person, commit fraud, or violate applicable laws.
We may refuse or discontinue a project where we reasonably determine that the requested website or activity is unlawful or materially violates these Terms.
18. Limitation of Liability
We aim to provide reliable and professional services, but no website or digital service can be guaranteed to operate without interruption or error at all times.
To the extent permitted by applicable law, DIY Your Biz will not be liable for indirect, incidental, special, or consequential losses arising from third-party outages, cyberattacks, platform changes, lost profits, lost data, advertising performance, search-ranking changes, or events outside our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
19. Changes to These Terms
We may update these Terms periodically to reflect changes to our services, business practices, or legal requirements.
The current version will be published on this website with an updated “Last Updated” date.
20. Governing Law
These Terms are governed by the applicable laws of the Federal Republic of Nigeria.
